 SUPA-eCart shopping is an online shopping, Dropshipping platform. This website, accessible at www.supa-ecart.co.za, including related mobile sites and software applications (collectively referred to as the “Website”), is owned and operated by SUPAView TV Pty Ltd registration number 2016/206116/07 (hereinafter referred to as “SUPA-eCart or SUPA-eCart.co.za,). The following Terms and Conditions (“Terms”) govern your use of the Website, as well as the ordering, sale, and delivery of goods available through this platform.

By accessing and registering on the Website, you agree to be bound by these Terms and Conditions. If you do not agree, you must stop using the Website immediately.

1.  Eligibility

You must be at least 18 years old to make purchases on our website. By using our services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract.

2.  Account Registration

To place an order, you may need to create an account. Only registered users may order goods on the Website. To register, you must provide a unique username and password, as well as certain personal information. You are responsible for maintaining the confidentiality of your username and password, and for ensuring they are used solely for your personal use. You must notify SUPA-eCart immediately if you suspect any unauthorized use of your account. By using the Website, you confirm that you are at least 18 years of age or are using the Website under the supervision of a parent or legal guardian, who agrees to be bound by these Terms.  You may not use the Website.

3.  Scope of Website Usage

The following Terms and Conditions (“Terms”) govern your use of the Website, as well as the ordering, sale, and delivery of goods available through this Dropshipping platform.

The Website offers an online Dropshipping shopping platform where users can purchase a wide range of goods, including but not limited to sports equipment, home and kitchenware, electronics, beauty products, books, and pet supplies (“Goods”) and the delivery of the Goods is managed by Third Party Sellers and Resellers. The availability of goods and services on the Website may vary based on geographic location, with delivery restricted to addresses within the Republic of South Africa.

4.  Privacy Policy

Your privacy is important to us. Our Privacy Policy outlines how we protect your personal information and is incorporated into these Terms by reference.

5.  Third-Party Sellers

SUPA-eCart allows third-party sellers to list and sell goods on the Website. SUPA-eCart is a Dropshipping company and therefore acts as a facilitator for transactions between you and third-party sellers. Specific terms apply to transactions with third-party sellers and will be clearly indicated on the relevant product pages.

6.  Payment

We offer secure online payment facilities, with transactions encrypted using industry-standard encryption technology. Payment may be made via debit card, credit card, direct bank deposit, electronic funds transfer (EFT), Instant EFT, or cash on delivery, subject to availability. By choosing a payment method and submitting your order, you confirm that you are authorized to use the selected payment method. Should any issues arise with your payment, SUPA-eCart reserves the right to withhold delivery until the matter is resolved.

Certain Goods may not be purchased for re-sale. Should we suspect that any such Goods are being purchased for sale, we are entitled to cancel your order immediately on notice to you.

Whether the Goods are for sale by SUPA-eCart or a Third Party Seller, payment may be made for Goods via the following methods (depending on its availability and/or your eligibility to use such a method) –

1.debit card; where payment is made by debit card, we may require additional information in order to authorise and/or verify the validity of payment. In such cases we are entitled to withhold delivery until such time as the additional information is received by us and authorisation is obtained by us for the amounts. If we do not receive authorisation your order for the Goods will be cancelled. You warrant that you are fully authorised to use the debit card supplied for purposes of paying the Goods. You also warrant that your debit card has sufficient available funds to cover all the costs incurred as a result of the services used on the Website;

2.credit card: where payment is made by credit card, we may require additional information in order to authorise and/or verify the validity of payment. In such cases we are entitled to withhold delivery until such time as the additional information is received by us and authorisation is obtained by us for the amounts. If we do not receive authorisation your order for the Goods will be cancelled. You warrant that you are fully authorised to use the credit card supplied for purposes of paying the Goods. You also warrant that your credit card has sufficient available funds to cover all the costs incurred as a result of the services used on the Website;

3.direct bank deposit or electronic funds transfer: if you pay via direct bank deposit   or electronic funds transfer, payment must be made within 5 (five) days of placing your order. SUPA-eCart will not accept your order if payment has not been received;

4.Instant EFT;

cash on delivery (except where any of our exclusions apply, as listed in our www.ecart.co.za/help); by selecting this option, you undertake to ensure that you have the exact cash on hand at the time of delivery.

7.  Important Notice

These Terms apply to consumers under the Consumer Protection Act (CPA). Certain provisions may limit SUPA-eCart’s liability or impose obligations on you.

Certain provisions within these Terms and Conditions may:

– Limit the risk or liability of SUPA-eCart or a third party;

– Impose obligations on you to indemnify SUPA-eCart or a third party; and/or

– Serve as an acknowledgment of certain facts by you.

Please read these Terms carefully and contact SUPA-eCart for clarification if needed. Please read these Terms carefully, as they are important and may impact your rights. Should you not understand any provision, you are responsible for contacting SUPA-eCart for clarification before continuing to use the Website.

Nothing in these Terms is intended to unlawfully limit or deprive you or SUPA-eCart of any rights under the CPA.

By using this Website, you are deemed to have accepted these Terms unconditionally. If you do not agree, you must cease using the Website immediately.

8.  Product Information

We strive to provide accurate and up-to-date information on our products, including descriptions, prices, and availability. However, we do not warrant that the product information on our website is always accurate, complete, or error-free. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information without prior notice.

9.  Order Processing and Shipping

Once an order is placed, it will be processed and shipped according to our Shipping Policy. You will receive a confirmation email with the details of your order and tracking information once your order has been dispatched.

Please note that delivery times may vary depending on your location and external factors beyond our control, such as customs delays or weather conditions.

SUPA-eCart offers delivery via courier or self-collection (where available). Delivery charges and times are subject to change, and the most up-to-date information is available during the checkout process.

Where it accepts your order, SUPA-eCart or the Third Party Seller will deliver the Goods to you as soon as reasonably possible, but no later than 30 (thirty) days of receipt of your payment (“Delivery Period”). We will notify you if we are unable to deliver the Goods during the Delivery Period. You may then, within 7 (seven) days of receiving such notification elect whether or not to cancel your order for the Goods. If you elect to cancel your order, we will reimburse you for the purchase price.

You cannot hold SUPA-eCart or the Third Party Seller liable if such Goods are not available or are not available at the particular price when you complete or attempt to complete the purchase cycle at a Delivery of Goods

Our obligation to deliver goods is fulfilled when the goods are delivered to the address provided by you. SUPA-eCart is not liable for any loss or unauthorized use of goods after they have been delivered.

10.     Returns Policy

For details on returning products, including refunds, replacements, and repairs, please refer to our Returns Policy, which is part of these Terms.

11.     Registration and Website Use

Only registered users may order goods on the Website. To register, you must provide a unique username and password, as well as certain personal information. 12.     Stock Availability

Registered users may place orders for goods on the Website, which SUPA-eCart or the Third-Party Seller may accept or reject. An order is only considered accepted once the goods have been delivered to you, or you have been notified to collect them. Until that point, any communication indicating that your order or payment has been confirmed is not binding.

You acknowledge that stock of all Goods on offer is limited and that pricing may change at any time without notice to you. In the case of Goods for sale by SUPA-eCart, SUPA-eCart will take all reasonable efforts to monitor stock levels and ensure that when stock is no longer available, that offers thereof are discontinued on the Website. However, we cannot guarantee the availability of stock. When Goods are no longer available after you have placed an order, SUPA-eCart will notify you and you will be entitled to a refund of any amount already paid by you for such Goods.

If an order is cancelled before delivery or collection, you may receive a refund in accordance with our Returns Policy.

Goods placed in a shopping basket or wish list without completing the purchase do not constitute an order and may be removed if stock becomes unavailable or prices change.

Prior to delivery or your collection of the Goods, you may cancel an order at any time provided you do so before receiving a dispatch or delivery notice. After delivery or your collection of the Goods, you may return the Goods only in accordance with the Returns Policy.

In the case of Goods for sale by a Third Party Seller, SUPA-eCart relies on inventory information supplied by the relevant Third Party Seller and SUPA-eCart accordingly bears no liability for any inaccuracies in the information supplied to it. Consequently, should you order any Goods from a Third Party Seller which are in fact sold-out, any resulting dispute should be resolved between you and the relevant Third Party Seller, your respective rights and obligations being as set out in these Terms and Conditions.

13.     Errors

SUPA-eCart strives for accuracy in all product descriptions, prices, and availability but cannot be held liable for errors, except in cases of gross negligence. In the event of a pricing error, you will be refunded any amounts paid.

SUPA-eCart shall not be bound by any incorrect information regarding our Goods displayed on any third party websites.

14.     Gift Vouchers & Coupons

Gift vouchers and promotional coupons are subject to specific terms and conditions. They cannot be exchanged for cash and must be used within the specified validity period.

15.     Same day Deals and Other Discounts

Discounted goods, including Same Day  Deals and other promotions, are subject to availability and may expire without notice. The terms and conditions for these promotions will be displayed on the Website.

16.     Online Course

Where payment is made by credit card, we may require additional information in order to authorise and/or verify the validity of payment. In such cases we are entitled to withhold delivery until such time as the additional information is received by us and authorisation is obtained by us for the amounts. If we do not receive authorisation your order for the Goods will be cancelled.

17.     Changes to Terms and Conditions

SUPA-eCart reserves the right to amend these Terms at any time. Changes will be effective once posted on the Website. Continued use of the Website signifies acceptance of the amended Terms.

By using the Website or communicating with us electronically, you consent to receiving electronic communications from SUPA-eCart in accordance with our Privacy Policy.

19.     Intellectual Property

22.     Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in accordance with South African law.

In the event of any dispute arising between you and SUPA-eCart for the Sale of goods, you agree that the Sale occurs in the Western Cape and you hereby consent to the non-exclusive jurisdiction of the High Court of the Republic of South Africa (Gauteng Division, Johannesburg) notwithstanding that the quantum in the action or proceedings may otherwise fall below the monetary jurisdiction of that court.

Nothing in this clause 22 or the Terms and Conditions limits your right to approach any court, tribunal or forum of competent jurisdiction in terms of the CPA.

23.     Disclaimer

The use of the Website is entirely at your own risk and you assume full responsibility for any risk or loss resulting from use of the Website or reliance on any information on the Website.

Whilst SUPA-eCart takes reasonable measures to ensure that the content of the Website is accurate and complete, SUPA-eCart makes no representations or warranties, whether express or implied, as to the quality, timeliness, operation, integrity, availability or functionality of the Website or as to the accuracy, completeness or reliability of any information on the Website. If any such representations or warranties are made by SUPA-eCart’s representatives, SUPA-eCart shall not be bound thereby.

SUPA-eCart disclaims liability for any damage, loss or expenses, whether direct, indirect or consequential in nature, arising out of or in connection with your access to or use of the Website and/or any content therein unless otherwise provided by law.

Although Goods sold from the Website may, under certain specifically defined circumstances, be under warranty, the Website itself and all information provided on the Website is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, completeness, or non-infringement, as may be allowed in law.

24.     Limitation of liability

1. SUPA-eCart cannot be held liable for any inaccurate information published on the Website and/or any incorrect prices displayed on the Website, save where such liability arises from the gross negligence or wilful misconduct of SUPA-eCart, its employees, agents or authorised representatives. SUPA-ECART shall not be liable for any direct, indirect, incidental, special or consequential loss or damages which might arise from your use of, or reliance upon, the website or the content contained in the website; or your inability to use the website, and/or unlawful activity on the website and/or any linked third party website.
3. You hereby indemnify SUPA-eCart against any loss, claim or damage which may be suffered by yourself or any third party arising in any way from your use of this website and/or any linked third party website.
